In June, 2002, the Rhode Island General Assembly adopted a major new lead law that affects most pre-1978 residential rental property to protect children from lead poisoning. For over a decade, the Rhode Island Association of REALTORS (RIAR) opposed changes to the existing lead law. When it became apparent that comprehensive lead legislation was going to pass, RIAR negotiated amendments to protect property owners from even more onerous requirements (i.e. a license to own rental property) but never supported the bill as a whole. RIAR negotiated further amendments to the new lead mitigation regulations which were adopted by the Housing Resources Commission and will go into effect on November 1, 2005. The following are practice tips for real estate licensees who own, sell, manage, lease, or help buyers purchase rental property.
