Compliance Resources for New Lead Laws

A number of new lead laws went into effect in 2023.  Most recently, the Rhode Island legal exemption for owner-occupied two- and three-family properties was eliminated as of January 1, 2024.  Those properties along with single-family dwellings, such as homes and condominiums, and multi-unit dwellings built before 1978 now must comply with lead mitigation laws.  Share this one-page fact sheet from the Rhode Island Department of Health with customers and clients. Another law requires sellers to give buyers of a 1 – 4-unit dwelling that was built before 2011 – instead of 1978 - a period of ten days to inspect for lead hazards.  This right must be included in the purchase and sales agreement.  The reason for this change is because there is greater concern about lead pipes, which were available until 2011.  Lead disclosure and lead hazard mitigation laws continue to apply to dwellings built before 1978.
